Terms of Service
Last updated 22 October 2026
These terms govern your use of the Sourcream website, dashboard, tracking script, API and related services (the Service), operated by Sourcream.ai Pty Ltd of Chatswood NSW, Australia ("we", "us", "our"). By creating an account or using the Service you agree to them. If you use the Service for a company or organisation, you confirm you are authorised to accept these terms for it.
1. Your account
You must be at least 18 and give accurate details when you sign up. Keep your login secure. You are responsible for everything done under your account, including by people you invite to it.
2. Plans and payment
The Service is sold as a subscription on the Starter, Business, Pro or Agency plan. Prices are in Australian dollars and exclude GST, which is added where it applies. Payments are processed by Stripe. Subscriptions renew automatically at the end of each monthly or annual period until you cancel.
Each plan includes a monthly lead allowance. A lead is one form submission captured by the Service. If you go over your allowance we tell you by email, and we may ask you to move to a plan that fits your usage. We do not stop tracking part way through a month because of it.
If a payment fails and is not resolved, we may suspend tracking until it is. Your data stays available to you while your account is suspended.
3. Your website visitors
When you install the tracking script, we process information about your website visitors on your behalf. You are responsible for:
- telling your visitors, in your own privacy policy, that you use Sourcream for marketing attribution;
- getting any consent the law requires before the script runs, using the consent modes the Service provides where needed;
- having a lawful basis to send the leads you capture to the CRMs and webhooks you connect.
Our Privacy Policy explains how we handle personal information, and our security and privacy page describes what the script collects.
4. Acceptable use
You must use the Service lawfully. You must not reverse engineer it, interfere with its security or infrastructure, use it to collect information you are not permitted to collect, send traffic intended to overload it, or resell it without our written agreement. We may limit, suspend or close accounts that breach these terms.
5. Your data
You own the data you and your visitors put into the Service. You give us permission to process it only to provide, secure and support the Service. You can export your leads at any time and delete your account from the dashboard.
6. Our service
All rights in the Service, including its software and design, belong to us. We aim to keep the Service available at all times but cannot promise it will be uninterrupted or error free. We may change or improve features, and we will give reasonable notice of changes that materially reduce what your plan includes.
7. Third party services
The Service connects to tools you choose, such as HubSpot, Salesforce, Pipedrive and webhooks. Their terms apply to your use of them, and we are not responsible for how they handle data once it is delivered to them.
8. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, including lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose.
9. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
10. Cancelling and closing accounts
You can cancel your subscription from the billing page in the dashboard. Your plan continues until the end of the period you have paid for. Refunds are covered by our Refund Policy. We may close your account if you seriously or repeatedly breach these terms.
11. Changes to these terms
We may update these terms. We will email account owners at least 14 days before a material change takes effect. If you keep using the Service after that, the new terms apply.
12. Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction over any dispute.
